The online store www.divjazena.com operates under the auspices of the company Divas d.o.o. (hereinafter "the provider"). These general terms and conditions are drafted in accordance with the Consumer Protection Act (ZVPot-1), the Electronic Commerce Market Act (ZEPT), and the General Data Protection Regulation (GDPR).

1. Company Information

2. Accessibility of Information

The provider undertakes to always provide the buyer with the following before the conclusion of the contract: company information, essential characteristics of the goods, prices (including taxes), delivery terms, and the complaint procedure.

3. Technical Steps for Concluding the Sales Contract

In accordance with ZEPT, the buyer carries out the purchase through the following technical steps:

  • Product Selection: The buyer selects a cosmetic product in the store and clicks "Add to cart."

  • Cart Review: The buyer can click on the cart icon at any time to view the selected products, their quantity, and price. Here, items can be removed or quantities changed.

  • Checkout (Data Entry): The buyer clicks "Checkout," where they enter their email address and delivery address.

  • Delivery and Payment Selection: The buyer selects the delivery method and payment method (card, PayPal, etc.). Before the final submission, they see a full summary of costs, including shipping.

  • Review and Confirmation (Placing the Order): By clicking the "Buy now" or "Pay now" button, the buyer places a binding order.

  • Technical Means for Identifying and Correcting Errors: Before clicking the order button, the buyer can click "Back" or individual sections to return to any previous step and correct any incorrectly entered data.

4. Conclusion of the Contract

The sales contract between the provider and the buyer is concluded the moment the provider sends the buyer the first electronic message confirming their order. The contract (order) is stored in electronic form on the Shopify server and is accessible to the buyer upon written request. The contract is concluded in the Slovenian language.

5. Prices and Payment Terms

All prices are in EUR and are valid at the time the order is placed. The provider is not registered for VAT based on Paragraph 1 of Article 94 of the ZDDV-1.

6. Right to Withdraw from the Contract (Returns)

The buyer has the right to withdraw from the contract within 14 days without stating a reason. Exception for cosmetics: In accordance with Point 5 of Article 135 of ZVPot-1, the buyer does not have the right to withdraw if, after delivery, they have opened the packaging, removed any safety cap, or any safety seal of the cosmetic product. Returns are only possible for unopened and unused products in their original packaging. The cost of the return is covered by the buyer. 7. Liability for Non-Conformity of Goods (Material Defects)

The provider is liable for the non-conformity of goods in accordance with the provisions of ZVPot-1. The buyer must notify the provider of the defect within the statutory period and allow for an inspection of the product.

8. Complaints and Disputes

The provider complies with consumer protection legislation and strives to resolve any disputes amicably. We accept complaints at info@divjazena.com.The provider does not recognize any out-of-court consumer dispute resolution provider.
